Specifically, the council has failed to increase the city’s earned income tax by 1 percent to 1.5 percent from 0.5 percent.
Council members have fought the tax hike.
“Inaction on this measure only causes greater delay and time is of the essence,” said Cory Angell, a spokesman for the Office of Receiver.
A writ of mandamus means “by the court’s command.” If a judge agrees with the receiver, the city’s elected officials will be required to follow the order.
Once a petition is filed, the court has 14 days to grant or deny it under the commonwealth's Act 47 law.
Lynch began warning city officials last month of his intention to involve the court.
