Capitol View developer awaits sentencing, bankruptcy case canceled

Defense counsel for West Shore developer David Dodd, responsible for the defunct Capitol View Commerce Center in Harrisburg, has been granted a 90-day extension to respond to a pre-sentence report.


Dodd pleaded guilty in November to federal fraud charges in connection with the $28 million defunct project.

As part of the plea agreement with the U.S. Attorney’s Office, the Hampden Township developer agreed to forfeit more than $1.15 million in assets seized from six brokerage accounts, two luxury vehicles and more than $58,000 in cash.

Dodd also agreed to pay restitution to the victims. He has been awaiting sentencing. The charges of money laundering and misappropriation of federal funds carry a maximum of 30 years imprisonment, a fine of $750,000 and probation, according to the court.

The U.S. Probation Office filed its pre-sentence report Jan. 25. The U.S. District Court for the Middle District of Pennsylvania granted the extension Wednesday, so Harrisburg-based defense counsel Cunningham & Chernicoff has until May 5 to file a response.

According to court documents, the report contains a number of allegations regarding the extent of the alleged amounts involved in Dodd’s criminal activities and the amount of the victims’ alleged losses. Attempts to negotiate restitution figures prior to the entering of the plea agreement were unsuccessful, according to the court.

Capitol View was planned as a 215,000-square-foot printing, office and retail facility at Cameron and Herr streets. It was supposed to transform the struggling redevelopment corridor.

But contractors walked off the site mid-build in spring 2008, claiming they had not been paid.

Dodd was promised more than $17 million in local, state and federal money to build the facility. He spent more than $8 million in public money before the project soured, according to financial records.

In other news, Dodd also was scheduled to appear in Harrisburg today for a Chapter 7 bankruptcy trial. That case was canceled after Dodd agreed to entry of an order denying his discharge, according to the U.S. Bankruptcy Court for the Middle District of Pennsylvania.

Over the summer, a start-up charter school emerged as an interested party to finish the half-built structure. Capitol View has been in possession of the court.

No formal offers have ever been made, according to the attorneys involved in the Chapter 7 case and Metro Bank, which foreclosed on the property. The Harrisburg School District also said it had no record of any application from the charter school.
